The subject of this contract is to determine the rights and obligations of the parties in accordance with the provisions of the Law on the Protection of Consumers No. 4077 and the Regulation on Distance Contracts regarding the sale and delivery of the product, whose qualities and sales price are specified below, and which the BUYER has ordered electronically from the SELLER's website www.dbpure.com.

The Buyer accepts and declares in this contract that they have been informed by the seller in a clear, understandable, and internet-appropriate manner about the seller's name, title, full address, telephone and other contact information, the basic characteristics of the goods subject to sale, the sales price including taxes, payment method, delivery conditions and expenses, etc., all preliminary information regarding the goods subject to sale and the exercise of the "right of withdrawal" and how to exercise this right, official authorities to whom complaints and objections can be submitted, etc., that they have confirmed this preliminary information electronically, and that they have subsequently ordered the goods.

The preliminary information on the www.dbpure.com website and the invoice issued based on the order placed by the buyer are integral parts of this contract.

Product/Payment/Delivery Information Subject to Contract

The type and kind, quantity, brand/model, sales price, payment method, recipient, delivery address, invoice information, and shipping fee of the product/products purchased electronically are as stated below. The person to be invoiced must be the same as the person making the contract. The information below must be accurate and complete. The buyer accepts and undertakes to fully compensate for any damages arising from inaccurate or incomplete information, and the buyer also accepts all responsibility that may arise from this situation.

The SELLER reserves the right to stop the order if the information provided by the BUYER does not match reality when deemed necessary. If the SELLER detects a problem with the order and cannot reach the BUYER through the telephone, e-mail, and postal addresses provided by the BUYER, the SELLER will suspend the execution of the order for 15 (fifteen) days. The BUYER is expected to contact the SELLER regarding the issue during this period. If no response is received from the BUYER within this period, the SELLER will cancel the order to prevent harm to both parties.

Contract Date and Force Majeure

The contract date is ../../…., which is the date the order was placed by the buyer.

Situations that are not existing or foreseen at the time of signing the contract, that develop beyond the control of the parties, and that make it impossible for one or both parties to partially or completely fulfill their debts and responsibilities under the contract or to fulfill them on time, will be considered as force majeure (Natural disaster, war, terrorism, rebellion, changing legislative provisions, seizure or strike, lockout, significant malfunction in production and communication facilities, etc.). The party in whose person the force majeure occurs shall immediately notify the other party in writing of the situation.

During the continuation of the force majeure, the parties shall not have any liability due to their inability to fulfill their obligations. If this force majeure situation continues for 30 (thirty) days, each of the parties shall have the right to unilaterally terminate the contract.

Seller's Rights and Obligations

5.1. The seller accepts and undertakes to fulfill the obligations imposed on him by the contract completely, except for force majeure, in accordance with the provisions of the Law on the Protection of Consumers No. 4077 and the Regulation on Distance Contracts.

5.2. Persons under 18 (eighteen) years of age cannot shop at www.dbpure.com. The seller will base the buyer's age on what is stated in the contract. However, the seller cannot be held responsible in any way due to the buyer's incorrect age entry.

5.2. www.dbpure.com is not responsible for price errors arising from system errors. Accordingly, the seller is not responsible for any promotional or pricing errors that may arise due to interventions in the website system, design, or illegal interventions. The buyer cannot claim rights from the seller based on system errors.

5.3. Purchases can be made at www.dbpure.com by credit card (Visa, MasterCard, etc.) or bank transfer. Orders for which a transfer is not made within one week from the order date will be canceled. The time when orders are processed is not the moment the order is placed, but the moment when the necessary collection is made from the credit card account or when the money transfer (EFT) reaches the bank accounts. Payment methods made without consulting customer service, such as payment on delivery or postal checks, are not accepted.

Buyer's Rights and Obligations

6.1. The buyer accepts and undertakes to fully fulfill the obligations imposed on him by the contract, except for force majeure.

6.2. By placing an order, the Buyer is deemed to have accepted the terms of the contract and accepts and undertakes to make the payment in accordance with the payment method specified in the contract.

6.3. The Buyer accepts and declares that they have clear, understandable, and internet-appropriate information about the seller's name, title, full address, phone and other contact information, the basic characteristics of the product subject to sale, the sales price including taxes, payment method, delivery conditions and expenses, etc., all preliminary information regarding the product subject to sale and the exercise of the "right of withdrawal" and how to use this right, official authorities to whom complaints and objections can be submitted, etc., from the www.dbpure.com website, and that they have confirmed this preliminary information electronically.

6.4. Pursuant to the preceding article, the Buyer declares that they have read and understood the www.dbpure.com order/payment/use procedure information, which includes product order and payment conditions, product use instructions, precautions taken against possible situations, and warnings, and that they have given the necessary electronic confirmation.

6.5. In the event that the Buyer wishes to return the product, they accept and undertake not to damage the product and its packaging in any way whatsoever, and to return the original invoice and delivery note at the time of return.

Order/Payment Procedure

Order:

The VAT-inclusive TL amount of the products added to the shopping cart (total installment amounts for installment transactions) is processed via the POS of the relevant bank card after being approved by the buyer. Therefore, an order confirmation email is sent to the customer before the orders are shipped. No shipment is made without sending an order confirmation email.

Any disruption in the process or problems that may arise with the credit card will be notified to the buyer using one or more of the telephone/fax/e-mail methods specified in the contract. If necessary, the buyer may be asked to contact their bank. The time when orders are processed is not the moment the order is placed, but the moment when the necessary collection is made from the credit card account or when the money transfer (EFT) is determined to have reached the seller's accounts.

In exceptional cases, if it is understood that the product subject to the contract cannot be supplied for a justified reason and/or a stock problem is encountered, the buyer will be informed clearly and understandably, and if they approve, another product of equal quality and price can be sent to the buyer, or at the buyer's wish and choice; another new product can be sent, the product can be waited for to enter stock or for other impediments to delivery to be removed, and/or the order can be canceled.

In cases where the delivery obligation of the product subject to the contract becomes impossible, the buyer is informed of this situation, and the total amount paid and any documents that put him in debt are returned to him within ten days at the latest, and the contract is canceled. In such a case, the buyer will not have any additional material and moral damage claims from the seller.

Payment:

At www.dbpure.com, cash transfer order options are offered to buyers who do not want to use credit card information on the internet. For money transfers, the buyer can choose the most suitable bank and make their transfer. If EFT has been made, the date of receipt will be taken into account. When making a money transfer and/or EFT, the "Sender Information" must be the same as the Invoice Information and the order number must be written.

If, after the delivery of the product, the buyer's credit card is used unfairly or unlawfully by unauthorized persons due to no fault of the buyer, and the relevant bank or financial institution does not pay the product price to the seller, the buyer is obliged to send the delivered product to the seller within 10 days. In such cases, shipping costs belong to the buyer.

If the Buyer has chosen to pay by credit card, the BUYER accepts, declares, and undertakes that they will separately confirm the relevant interest rates and information regarding default interest from their bank, and that the provisions regarding interest and default interest will be applied within the scope of the "Credit Card Agreement" between the Bank and the BUYER in accordance with the provisions of the current legislation.

Warranty

The seller's warranty liability is only valid for consumers covered by Law No. 4077. For commercial transactions, the provisions of the Turkish Commercial Code will apply.

Privacy

The information specified in this contract by the buyer and the information notified to the seller for payment purposes will not be shared by the seller with 3rd parties.

The seller may disclose this information only within the framework of the existence of administrative/legal necessity. The seller may provide the information requested from him to the relevant authority within the scope of any judicial investigation documented with investigative authority.

Credit Card information is absolutely not stored. Credit Card information is only used to obtain authorization by securely transmitting it to the relevant banks during the collection process and is deleted from the system after authorization. Buyer's e-mail address, postal address, and telephone number are used only by the seller for standard product delivery and information procedures. Campaign information, new product information, and promotional information may be sent to the buyer after their approval at certain times.
